Instructional / Classroom Use of VHS / DVD at TWU/ACTS


What follows is a general overview of the issues involved in the instructional use of VHS tapes / DVDs in class at TWU. Click on the links embedded in the flow-chart below to go to more detailed explanations. For further clarification please feel free to contact: Ted Goshulak or local 3905.

Trinity Western University Library Media (VHS tapes / DVDs):
 

VHS tapes / DVDs included in the TWU Library Media Collection have two possible kinds of rights:

home loan

1. Home Loan Only: allows a library patron to view the program in their home or in the Library. Excludes the use by faculty of the program in the classroom or at home with students present. However, some Home Use Only items may be covered by our Feature Film Licence, in which case faculty may use them in class.

Videos with this restriction will be clearly marked with the sticker shown on the left.

2. Limited Public Showing: allows faculty to show the program in a classroom setting.

Non-TWU VHS tapes / DVDs:
 

1. VHS tapes / DVDs borrowed via the Media Exchange Co-operative (MEC):

TWU belongs to a 23-member consortium of B.C. post-secondary institutions. Faculty may request VHS tapes or DVDs from one of these institutions within the following parameters:

  • items must be booked at least one week in advance. A charge of $5.00 (loan) in addition to the cost of a courier are charged back to the academic department (courier charges are $13-$15 for a round trip shipment. (Prices subject to change).

  • the item(s) must be returned to the Library immediately after showing.

NOTE:

  • Check the ELN Media Catalogue for media titles held by MEC libraries before booking.
  • *Some MEC videos may be labelled "Home Loan Only" but are covered under our Feature Film Licence. This information will usually be included with the video.

2. Home recorded television shows:
  • may not be shown in a classroom setting without the written permission of the copyright holder. See Off-Air Taping Update for information on reproduction, record keeping and tariff issues should you, as a faculty member, decide to "go this route." (NOTE: this only applies to Canadian media outlets).

3. Commercially Available DVDs (e.g., box sets of TV shows, or DVDs from rental shops):
  • TWU has a feature film licence with Audio Ciné and Criterion, for the showing of designated distributors' VHS tapes / DVDs in the classroom. A current list of the distributors covered by the licence can be found at: http://www.twu.ca/library/ffilm.htm

  • To determine who the distributor for a particular VHS / DVD is:

  • If the distributor is NOT covered by the license, you cannot show the VHS / DVD in class without contacting the distributor directly and determining the cost of showing the VHS / DVD.

4. VHS tapes / DVDs borrowed from a public library:
  • cannot be shown in a classroom setting. These programs have "Home Loan Only" rights. The only exception is for feature films which are covered by our feature film licences.
